Terms and Conditions

Operator of the online platform sexabc.ch as well as all associated subdomains and further technical or regional subdomains (hereinafter collectively the Platform), is:

Webline GmbH operates an internet-based platform for the publication of erotic advertising in the form of advertisements, banners and club presentations; technical management and delivery of these forms of advertising take place via inseratportal.ch. sexabc.ch provides, among other things, search, filter and entry functions for the display of the content.

The Platform provides exclusively technical infrastructure for the creation, management and display of advertising content.

The Operator acts exclusively as a host provider. There is no brokering, organisation, control or monitoring of services between users or between users and third parties.

The Operator shall in no case become a contracting party to agreements concluded between users or between users and contact persons.

No specific commercial outcome is guaranteed, including any particular reach, placement, visibility, number of views, clicks or contacts.

These General Terms and Conditions govern all legal relationships between the Operator and the users of the Platform.

Divergent, conflicting or supplementary terms and conditions of the user shall not apply.

The Operator is entitled to amend these GTC at any time. The respectively current version is published on the Platform. Amendments shall be deemed accepted unless the user objects within 14 days of notification.

The Operator provides all services exclusively on the basis of these GTC. These GTC form an integral part of all contractual relationships between the Operator and the user, regardless of whether these come into existence through registration, booking, use or other utilisation of services.

Divergent or supplementary agreements shall only be effective if they have been expressly confirmed in writing by the Operator. Oral collateral agreements, telephone information, support responses, chat messages or other informal assurances shall not become part of the contract.

Consent to these GTC is given electronically and is equivalent to a handwritten signature.

Use of the Platform is permitted exclusively to persons aged 18 or over.

By registering on inseratportal.ch, the user confirms in a legally binding manner that he or she is of legal age and has legal capacity.

The Operator is entitled to demand proof of age or identity at any time. In the event of non-submission, immediate blocking or deletion of the user account is permissible.

Use of the Platform requires the creation of a personal user account, insofar as required for the respective use; registration, account and access are managed exclusively via inseratportal.ch - not on sexabc.ch.

The user is obliged to provide complete, truthful and current information and to keep this continuously up to date.

Access data must be kept secret. The user is liable for all actions that take place via his or her user account, unless he or she proves that he or she is not at fault.

A user account is personal, non-transferable and may be used exclusively by the registered user.

The Operator is entitled to block or delete user accounts without prior notice in the event of misuse, false information, multiple registrations or breaches of these GTC or applicable law.

Erotic advertising content intended for adults is permitted.

Escort and companion services are permissible provided they are in accordance with applicable Swiss law.

The user is solely responsible for ensuring that his or her activity, advertising and its design comply with all statutory provisions.

The following content is strictly prohibited in particular:

• concern or depict minors
• contain sexual acts with minors or the suggestion thereof
• advertise illegal services
• advertise unprotected sexual intercourse or AO
• mention drugs, medicines or prohibited substances
• depict violence, coercion, exploitation or humiliation
• are racist, discriminatory or inhumane
• infringe personality rights, copyrights or trademark rights of third parties
• contain untrue or misleading information

These rules apply uniformly to all forms of advertising on the Platform.

Advertising may promote only genuine, legally permissible services intended for adults.

False, misleading or purely virtual offers without a physical location where services are provided in Switzerland are not permitted.

Exclusively own, authentic images and videos may be used. Third-party content without rights, stock material without proof, manipulated or AI-generated identities are prohibited.

Contact details may be provided exclusively in the fields provided for this purpose.

The user is obliged to comply with all permits, concessions or statutory requirements necessary for his or her activity. The Operator is entitled to request corresponding proof at any time.

The Operator is entitled to hide, block or delete advertising content in whole or in part at any time. There is no claim to publication, placement or visibility.

In the event of serious or repeated breaches, the following are permissible:

• permanent blocking or deletion of the user account
• immediate termination of ongoing advertising placements
• forfeiture without compensation of existing credits

The user bears the sole civil, criminal and administrative responsibility for all content published by him or her.

The Operator has no obligation to review content in advance and is not liable for user content.

The Operator is not obliged to actively monitor content or verify its commercial legitimacy or the actual ability to provide the advertised services.

The user grants the Operator a non-exclusive, non-transferable licence to display the content on the Platform and on connected partner sites.

The right of use exists exclusively for the duration of the publication and ends automatically upon deletion of the respective content.

After deletion, there is no claim to restoration, archiving or surrender of data. The duty of backup lies with the user.

Paid functions are provided through a virtual credit system; credits are purchased and managed exclusively via inseratportal.ch.

Credits must be purchased before use. One credit has a value equivalent to one Swiss franc.

Credits are personal, non-transferable and cannot be redeemed for cash.

The value added tax treatment takes place in accordance with the respectively applicable tax law provisions.

Credits cannot be refunded or paid out.

Credits do not generally expire. In the event of permanent inactivity of the account (no login during 24 consecutive months), remaining credits shall be cancelled without compensation. Affected users shall be informed by e-mail 30 days prior to the expiry.

Bonus, advertising or free credits may be withdrawn without compensation in the event of misuse, circumvention attempts or breaches.

Advertising content is activated for a duration chosen by the user.

Upon expiry, automatic deactivation takes place.

There is no claim to extension, republication or refund.

The Operator does not guarantee any specific availability, reach, placement, views, clicks or contacts.

Functions, forms of presentation, categories or technical processes may be changed, restricted or discontinued at any time.

The user shall have no claims as a result.

Third-party providers are used for hosting, content delivery, payment processing, media processing and further technical services.

The Operator is not liable for outages or disruptions outside its control.

The user may close his or her user account at any time.

There is no claim to refund of credits or ongoing services.

In the event of breaches of these GTC or statutory provisions, the user account may be suspended or deleted immediately.

Circumvention attempts of technical protection mechanisms, multiple accounts or the renewed posting of deleted content shall in particular also be deemed serious breaches.

In the event of serious misuse, the remaining credit balance shall be forfeited without compensation.

The Operator is liable exclusively for damage caused intentionally or by gross negligence.

Liability for slight negligence, indirect damage, consequential damage, lost profit or data loss is excluded insofar as legally permissible.

Liability for auxiliary persons is excluded to the extent legally permissible.

The user undertakes to indemnify the Operator against all third-party claims arising from user content or other breaches of these GTC.

The indemnification also encompasses reasonable costs of legal defence.

The processing of personal data takes place in accordance with the separately published Privacy Policy.

The Privacy Policy is an integral part of these GTC.
